Perchè ci interessa
L’attuale quadro normativo disciplina con chiarezza che i rapporti tra pubbliche amministrazioni e Ets possono essere regolati sia attraverso modalità collaborative (Codice del Terzo Settore) sia attraverso modalità concorrenziali (Codice degli appalti). La riforma del Codice degli appalti interessa soprattutto in considerazione dell’opportunità che tali diverse modalità di regolazione dei rapporti non mutino in alcun modo.

Il testo del decreto legislativo approvato in prima lettura dal Consiglio dei Ministri è attualmente all’esame delle Camere per il parere (XIX legislatura – Atto del Governo n. 19).
Possono essere ancora forniti suggerimenti per migliorare il testo dell’art. 6 del decreto legislativo in questione.
Cosa può fare un ets
Il percorso è prettamente normativo.
Gli Ets e la loro rappresentanza sono chiamati a vigilare affinché le due modalità di rapporti (collaborativo/concorrenziale) continuino ad essere chiaramente definite.

Nella seduta del 16 dicembre 2022 il Consiglio dei Ministri ha approvato, in esame preliminare, il decreto legislativo di riforma del Codice dei contratti pubblici, in attuazione dell’art. 1 l. 21 giugno 2022, n. 78, recante “Delega al Governo in materia di contratti pubblici”.
Il testo del decreto legislativo è attualmente all’esame delle Camere per il parere (XIX legislatura – Atto del Governo n. 19).
